So my company decided on doing The 39 Steps this summer. When I called Samuel French they told me that the rights where restricted across the country, and they I had to apply through their professional department. And that they would give it the yay or nay. Has anyone else done this? Do the rights usually get approved? Where a community theatre, does that matter?

That's a soft no.  Chances are that there's a roaming professional tour, or oddly, some static professional production has paid for some degree of exclusivityon the title.  You can apply and see what the actual blackout is, but start looking elsewhere.

Yep, the show was in the Detroit area a couple of months ago.

Two theatre companies in New Brunswick have it slated to run next season.  One professional and one community so the rights can't be that restricted.
