Need some advice..The short part of the story: We're five weeks from opening and someone playing an important role was just arrested in the state capitol in an Earth First action that involved barricading traffic. The trial date is set for a week before opening and according to the papers the prosecutors are looking for jail time to set an example.

absolutely, your actor I doubt will be at the top of his game even if he's found not guilty. He'll have 5 weeks of stressing out which you don't need to bring into your rehearsals.

yea, but that kind of publicity can easily work against you.  I would recast and just go from there.  Or if you don't want to do that,  get an understudy in case something happens in the meantime.  At least you will be covered in the worst case scenario.

Puts me in mind of an incident with the company I worked with for about 20 years...when they had cast an actor to play a role, he was well-cast, perfect for whatever the role and show was, but on or near OPENING NIGHT, the police showed up to arrest him..........for MURDER!!!!  And the odd thing was - and I don't get how they pulled this off - but the judge ALLOWED him to do the run of the show and he was fine throughout, doing his job, and even got some critical notice for his part in it. BUT there was a distinct ARMED GUARD on duty every night of the run until the show closed and the actor, of course, was escorted back to jail every night.  Then naturally when it was all over with he went to trial and was found guilty, sentenced and is serving time still I guess.  But up until that night when the cops came to arrest him, the rest of the cast had NO clue that this guy was a murderer.  Made for very interesting times during the run with his fellow actors who I guess acted as though it didn't bother them - but I know it did.
 
Crazy stories for the book someday!! HAHA!!
