Hi Everyone,
I'd like to use 3-5 second video clips and stills of our performances for a commercial...a teaser type, very fast action. No show would be identified by name or title, and it would be pretty difficult in any case for anyone to even identify the show based on the very short duration of the clips. Any experience on this? Our CT is planning on a commercial designed to promote general interest in our theater and also promo season tix. This spot is not designed to promo any specific event, performance or production. Experiences, opinions and thoughts would be appreciated! Thanks, Larry |

As I recall, up to 30 seconds can be used for promotional purposes without raising a ruckus, but that information could be out of date or just wrong (old age is gettin' here faster every year).

Permission for this sort of thing generally varies from show to show, your safest option would be to contact the companies that licensed the shows to see what thier policies are.

I think under the Fair Use Doctrine, you might be able to use short clips like you are talking about, however there is still the question of the video tape from which you took the clips (see the various threads about videotaping performances). Still photos of a show are a different matter. As far as I know, nothing in any of the performance agreements forbids still photography... after all, the playwright does not own the rights to the likenesses of the actors. If you really want to use the video clips, go with Dan's advice and secure permission to video first... that way, you're covered.
